Terms of Service

Who We Are

Sörk is operated by Mihkel Hõbemägi, a sole proprietor (FIE) registered in the Estonian Business Register under registry code 17408604, based in Tallinn, Estonia. In these Terms, "Sörk," "we," "our," and "us" refer to that business. You can reach us at info@soerk.app.

Agreement to Terms

By accessing or using Sörk, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with these terms, please do not use the service.

Description of Service

Sörk is a retrospective and feedback platform that helps teams and individuals turn feedback into follow-through. The service is organised around a Share → Reflect → Act loop and includes:

  • Structured feedback sessions, which can be run live or asynchronously
  • Feedback that may be submitted anonymously, without an author name attached
  • Outcome Lock — every feedback item carries an expected outcome
  • Commitment tracking, with due dates, owners, and evidence of what actually happened
  • A Personal Reflection mode for individual use
  • Session analytics and summaries derived from what participants enter
  • Custom feedback templates, and email notifications on paid plans

A demo session is available without an account and does not save any data. Guest participants may join a shared session by entering a display name, without registering.

Account Registration

To create a Sörk account, you must:

  • Provide accurate and complete registration information
  • Confirm your email address before your account becomes active
  • Maintain the security of your account credentials
  • Be at least 16 years of age
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

Accounts are created with an email address and password. Guest participants who join a session by name do not create an account and have access only to that session.

Subscription Plans

Free (€0)

Includes the Personal Reflection workspace, commitment tracking, and basic templates. Sessions are limited to 6 participants. No payment card is required.

Team (€9/month)

Includes everything in Free, plus sessions of up to 20 participants, custom templates, email notifications, and advanced analytics. New Team subscriptions begin with a 7-day free trial.

Enterprise (custom pricing)

Unlimited participants, a private organisation dashboard, custom solutions, and priority support. Terms are agreed individually — contact sales@soerk.app.

Plan features and participant limits are those described on our pricing page at the time you subscribe. We may change what is included in a plan, and will give you reasonable notice of any material reduction.

Free Trial

  • The Team plan starts with a 7-day free trial. You will not be charged during the trial period.
  • Unless you cancel before the trial ends, your subscription automatically continues as a paid Team plan at €9 per month, and the first payment is taken at that point.
  • You can cancel at any time during the trial from your account settings, at no cost.
  • Free trials are intended for new subscribers, and we may decline a trial where one has already been used.

Payment Terms

  • Paid subscriptions are billed monthly in advance, in euros, and renew automatically until cancelled
  • Payments are processed by our payment provider, Creem. We never receive or store your full card details
  • You may cancel your subscription at any time, and you keep access until the end of the billing period you have already paid for
  • We do not generally refund fees for a partly used billing period, but this does not affect your statutory rights, including any right of withdrawal you may have as a consumer under EU law
  • We may change pricing with at least 30 days' notice, and the new price applies from your next renewal
  • Failure to pay may result in suspension or termination of the service

User Content

You retain ownership of all content you create in Sörk — feedback, expected outcomes, sessions, commitments, notes, and templates. By using the service, you grant us a limited license to:

  • Store and display your content as necessary to provide the service
  • Process your content to provide features such as analytics and summaries
  • Back up your content for data protection purposes

This license exists only so that we can run the service for you, and it ends when you delete the content or your account. We do not sell your content, and we do not use it to train machine learning models.

You are responsible for the content you create. Because Sörk is used to give feedback about work and colleagues, you must ensure your content is lawful, does not harass or defame anyone, and does not infringe third-party rights.

Anonymous Feedback

Feedback submitted anonymously is displayed to other participants without your name. Anonymity applies to what other users see — it is not a guarantee against identification, since the content itself may reveal who wrote it. Anonymous submissions are still stored in our database, and we may access them where necessary to operate the service, investigate abuse, or comply with the law.

Acceptable Use

You agree not to:

  • Use the service for any illegal purpose
  • Violate any applicable laws or regulations
  • Harass, bully, threaten, or defame any person through session content
  • Infringe upon the rights of others
  • Transmit harmful code, viruses, or malware
  • Attempt to gain unauthorized access to our systems or to other users' sessions
  • Interfere with the proper functioning of the service
  • Use automated systems to access the service without permission
  • Resell or redistribute the service without authorization

Analytics and Summaries

Session analytics, health statistics, and summaries are derived from the information you and your participants enter. They are provided as-is, are not advice, and may be incomplete or misleading if the underlying input is. You are responsible for reviewing them before relying on them to make decisions about people or work.

Organisation and Enterprise Accounts

Where your access to Sörk is provided through an Enterprise account managed by your employer or another organisation, that organisation administers the account, may invite and remove members, and can see activity and usage information about its workspace. Your agreement with that organisation governs your use of the account, and these Terms apply alongside it. If there is a conflict, the written agreement we have signed with the organisation prevails.

Service Availability

We aim to provide reliable service but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any aspect of the service with reasonable notice.

Intellectual Property

The Sörk platform, including its design, features, and underlying technology, is owned by us and protected by intellectual property laws. You may not copy, modify, or reverse-engineer any part of our service.

Limitation of Liability

To the maximum extent permitted by law:

  • We provide the service "as is" without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount you paid us in the 12 months before the claim
  • We are not responsible for loss of data, though we maintain regular backups

Nothing in these Terms excludes or limits our liability where it cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection rules.

Indemnification

If you use Sörk in the course of a business, you agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the service, your content, or your violation of these terms. This section does not apply to consumers.

Termination

We may terminate or suspend your account if you:

  • Violate these Terms of Service
  • Fail to pay applicable fees
  • Engage in fraudulent or abusive behavior
  • Create risk or legal exposure for us or others

You may delete your account at any time from your account settings. Upon termination, your right to use the service ceases immediately. You may request an export of your data within 30 days of termination, after which it is deleted as described in our Privacy Policy.

Governing Law and Disputes

These Terms are governed by the laws of Estonia. Any disputes arising from these terms or your use of the service will first be addressed through good-faith negotiation. If negotiation fails, disputes will be subject to the exclusive jurisdiction of Harju Maakohus (Harju County Court), Estonia.

If you are a consumer resident in the European Union, this does not deprive you of the protection of mandatory provisions of the law of your country of residence, and you may bring proceedings in your local courts. Consumers may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.

Changes to Terms

We may modify these Terms of Service. We will notify you of significant changes via email or through the service, with reasonable notice before they take effect. Continued use after changes take effect constitutes acceptance of the new terms. If you do not accept them, you may cancel your subscription and delete your account.

Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
